To be able to determine the legality, you'll need to find out the total length of allocated break per day. It's mostly an hour for a 7-9 hours shift. It could mean that your son gets two lots of 15 mins breaks and 30 mins at lunch time. Most organisations are flexible in terms of how and when you take your allocated break. You'll need to ask your son for more details and perhaps go through his contract to see what it says as it would be unfair to give smokers more breaks than non smokers or vice-versa.
